These TERMS AND CONDITIONS of service is made between eWebNet Marketing, hereinafter called "Company", and the person/company ordering a Desktop Marketing Toolkit (Desktop Broadcast Publishing account), hereinafter called "Client".

The Company may update or amend these terms and conditions at any time. The Company will communicate any such updates to Client via email and these changes will be displayed on this page.

All Desktop Marketing Toolkit (Desktop Broadcast Publishing) accounts are setup automatically and first month of service is free, thereafter service is $9.99 per month billed on a prepay basis every 30 days, and will be charged automatically to the Client credit / debit card number on file or Client paypal account

The Client is responsible to keep credit / debit card or paypal account used for payment up to date which includes the expiration date, and sufficient funds to cover account fees.

In the event the credit / debit card or paypal account declines payment for any reason, the Client will be notified by email. Past due accounts that are not brought current within 7 days of the email notice are subject to suspension and possible account termination.

Clients can cancel service any time. To cancel Client needs to complete Cancel Request Form at http://www.ewebnetmarketing.com/cancel/ Upon notification that an account has been cancelled by Client, the Company will delete the Clients account from the server. Company will not wait until the end of any billing cycle, and Company will not refund any unused portions of any payment.

Company reserves the right to cancel service at any time. If service is cancelled by Company, fees paid in advance by Client of cancellation will be pro-rated and paid by Company. If cancellation is caused by Clients violation of Company terms, then no refund will be disbursed.

Services are Intended for the Client use only. Clients cannot sublease, sub host, or give away control of any portion of Desktop Marketing Toolkit (Desktop Broadcast Publishing) account.

Client agrees the resources which Desktop Marketing Toolkit (Desktop Broadcast Publishing) account provides are respected and not abused by user. Any fraud, scam, porn, using Desktop Marketing Toolkit (Desktop Broadcast Publishing) account resources is strictly prohibited and will be dealt with accordingly.

An affiliate will not receive any commission for a Desktop Marketing Toolkit (Desktop Broadcast Publishing) account ordered for his / her use under his / her own affiliate link.

The Company will utilize its best efforts to maintain acceptable performance of services, but the Company makes absolutely no warranties whatsoever, express or implied, including warranty of merchantability or fitness for a particular purpose. The Company cannot guarantee continuous service, service at any particular time, or integrity of data stored or transmitted via its system or via the Internet.

The Company shall not be liable to Client or any of its customers for any claims or damages which may be suffered by Client or its customers.

If any provision of these terms and conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
